Advocate Anton Katz, leading the legal team for Dr Nandipha Magudumana, argued before the Constitutional Court that her 2023 deportation from Tanzania to South Africa subverted international law.

Katz contended that her removal was not a lawful deportation but rather a “disguised extradition” or abduction. He emphasized that legitimate extradition requires a bilateral agreement between states, a process he claims was bypassed.

Magudumana approached the Constitutional Court to challenge the legality and validity of her deportation following a previous dismissal by the Supreme Court of Appeal in Bloemfontein.
